Trump to sue DOJ over Mar-a-Logo raid

Former President Donald Trump is preparing to sue the Justice Department for $100 million, accusing the agency of “political persecution” in connection with the 2022 raid on his Mar-a-Lago estate in Palm Beach, Florida. Trump’s legal team contends that the raid, part of a federal investigation into his handling of classified documents, was carried out with the intent to target him politically.

According to a memo first obtained by Fox News, Trump’s legal representatives argue that the U.S. government engaged in “tortious conduct” against him during the raid conducted by the FBI on August 8, 2022. This legal action comes after Special Counsel Jack Smith, appointed to oversee the investigation, charged Trump with 37 felonies, including willful retention of national defense information and obstruction of justice. Trump pleaded not guilty to all charges.

However, U.S. District Judge Aileen Cannon dismissed the case last month, ruling that Smith’s appointment and the subsequent indictment were unconstitutional due to a violation of the Appointments Clause. This ruling has paved the way for Trump’s lawsuit against the Justice Department, which his attorney Daniel Epstein has already filed a notice for. The Justice Department now has 180 days to respond before the case potentially moves to federal court in the Southern District of Florida.

In a statement to Fox Business, Epstein emphasized that Trump’s legal action is not only a defense of his own rights but also a stand for all Americans who believe in the rule of law. Epstein’s filing accuses the Justice Department and the FBI of violating Trump’s privacy rights, engaging in malicious prosecution, and abusing legal processes.

I think Trump has a good case, but based on what has happened to date it is an open question whether he can get a fair hearing on his allegations.
