The FBI's rioter double standard

Rep. Markwayne Mullin took aim at FBI Director Cristopher Wray during a House Select Committee on Intelligence hearing, questioning what he sees as the FBI’s double standard in prosecuting Capitol rioters and those in Portland.

“Under the Biden administration, there appears to be a wave of leniency being granted to individuals arrested for federal crimes in Portland,” Mullin, a Republican from Oklahoma, said during the hearing. “Federal prosecutors are apparently approving deferred resolution agreements in a number of cases and allowing perpetrators to do community service and avoid jail time and criminal records. Why are we seeing such a disparity between the individuals charged on Jan. 6 and those that are charged in Portland?”

Wray at first responded by pinning the blame on local prosecutors, noting that the FBI only investigates the crimes but does not make decisions about prosecution.

That answer didn’t sit well with Mullin, who argued that the FBI does make recommendations and continues to insist that there was a disparity between prosecutions of the Jan. 6 riot and the riots in Portland.

“Is there a difference between the two, the way they’re being charged?” Mullin asked. “You have 140-plus federal officers that have been injured in Portland alone. You have federal buildings that have been attacked, been burned, been stormed. And you’re not treating it the same as you are with Jan. 6. Would you agree with that, yes or no?”

“I believe we, the FBI, are taking a consistent approach in both situations,” Wray responded.

“I don’t buy that,” Mullin shot back.

Federal prosecutors have switched gears to showing more leniency for rioters in Portland under the Biden administration, with prosecutors cutting deals in at least half a dozen felony cases in recent weeks.

“Obviously, there was a change in direction from Washington, and once they changed the U.S. attorney, that seemed to change the tone,” said John Kolego, a defense attorney based Oregon who handled one of the Portland cases. “They had their marching orders from Barr before, but the tone is definitely changed.”

What they are doing is falsely accusing people involved in the Capriol riot of sedition.  There is little evidence to support this charge but Democrats want to punish rioters who are supporters of Trump and Democrats want to excuse Antifa and BLM rioters who for some reason are supported by Democrats.
