Obama administration is in violation of the clear language of the healthcare law

Opinion Journal:
ObamaCare's Latest Legal Challenge 
Can the White House simply declare that the federal government is the 51st state?
Will the courts ignore the clear language of the act as well as the Congressional intent?  That is what the administration is arguing for.
