Appeals court asks for more arguments on judges ruling about immigration restrictions

Appeals court declines to quickly reinstate travel ban

The 9th Circuit denied a request filed by the Trump administration to immediately restore the restriction on U.S. entry, instead asking both sides to file more arguments by Monday afternoon.

The acting solicitor general described a federal judge’s temporary halt to the immigration order as “judicial second-guessing” and an “impermissible intrusion” on presidential authority.
The 9th Circuit has a reputation for being very liberal.  If it rules against the Trump administration, it would be wise to ask for an embank rehearing on the matter before taking it to the Supreme court to give the Senate time to approve the Gorsuch appointment and avoid having to deal with a four-four split which would affirm a bad decision.
