Has he been charged with treason?

Washington Post:
U.S. judge says American accused of fighting for ISIS must get lawyer

A federal judge ruled Saturday that the U.S. military must provide legal counsel to a U.S. citizen who was picked up months ago on the Syrian battlefield and accused of fighting with Islamic State militants.
Right now he is just a suspected unlawful enemy combatant who happens to be a US citizen.  If he is in fact, an American who has been fighting for the enemy, he could be charged with treason.  That would be when he would need a lawyer.  If the ACLU is looking for a habeas corpus release they are endangering anyone who comes in contact with this guy.
