New terrorist rights for Gitmo detainees could lead to release in US

Administration officials are considering granting Guantánamo detainees substantially greater rights as part of an effort to close the detention center and possibly move much of its population to the United States, according to officials involved in the discussions.

One proposal that is being widely discussed in the administration would overhaul the procedure for determining whether detainees are properly held by granting them legal representation at detention hearings and by giving federal judges, not military officers, the power to decide whether suspects should be held.

Although the Bush administration has long defended the legal protections afforded detainees at Guantánamo against strenuous criticism, some officials now say that moving them to American soil would require giving them enhanced protections.

“If you were to bring them to the United States, there is a recognition that for policy reasons you would need even more robust procedures than those currently at Guantánamo,” one senior official involved in the discussions said, speaking on the condition of anonymity because no decisions have been made.

This is a very bad idea. The terrorist rights groups will not stop until the terrorist receive full constitutional rights, which means all of them would have to be released once they got he the US, because none has been given a Miranda Warning. You can bet that however "robust" the new regime might be it will not be robust enough for the ACLU and the other useful idiots of al Qaeda. There is no amount of additional rights that will be enough for these groups.

It would also be a capitulation to the lawfare mode of fighting the war, which means we will have to turn over our sources and methods of gathering intelligence on the enemy trying to destroy us too. There will also be no PR benefit to such a move, because left will just continue to oppose the defeat of the enemy. I can see nothing good coming out of this idea.

We need to keep them at Gitmo for the duration of the conflict and quit worrying about the PR.
