Bad idea of the day

If someone has indicated they support the enemy and they are on the battlefield with the enemy it should not take a judge to make a decision. It should not take a President for that matter. Why anyone is concerned about the demise of Anwar Awlaki is a mystery to me.
That would be a good way to insure that no one is ever struck down by a drone. It would have all the evils of the lawfare mentality only worse. The two opposing views would be presented to the judge and he would think about it while the terrorist makes his get away, and the losing party would be planning its appeal to a higher court.
